Agreement to Terms
These Terms of Service ("Terms") govern your use of the website and in-home senior care services provided by Assisted Living Florida ("we," "our," or "us"). By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
Our Services
Assisted Living Florida provides in-home senior care services including but not limited to:
- In-home care and companionship
- Personal care assistance
- Memory care support
- Respite care for family caregivers
- 24/7 care options
- Transportation services
- Medication management
Specific services are provided pursuant to a separate care agreement that outlines the scope, schedule, and fees for care services.
Service Agreement
In-home care services are governed by a separate Care Service Agreement executed between Assisted Living Florida and the client or client's authorized representative. This agreement outlines:
- Specific care services to be provided
- Schedule and hours of service
- Payment terms and fees
- Termination provisions
- Rights and responsibilities of both parties
In the event of any conflict between these Terms and the Care Service Agreement, the Care Service Agreement shall control.
Client Responsibilities
As a client of Assisted Living Florida, you agree to:
- Provide accurate and complete information about care needs
- Notify us of any changes in health status or care requirements
- Maintain a safe environment for our caregivers
- Pay for services as agreed in the Care Service Agreement
- Treat our caregivers with dignity and respect
- Provide access to the home as needed for care services
Payment Terms
Payment terms for services are specified in your Care Service Agreement. Generally:
- Service fees are due according to the agreed schedule
- We accept various forms of payment as specified
- Late payments may incur additional fees
- Services may be suspended for non-payment
- Refund policies are outlined in the Care Service Agreement
Cancellation and Termination
Either party may terminate care services according to the terms in the Care Service Agreement. Generally:
- Clients may cancel with adequate notice as specified in their agreement
- We may terminate services for non-payment or safety concerns
- Final charges will be calculated based on services provided
Limitation of Liability
To the fullest extent permitted by law, Assisted Living Florida shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our services.
Our total liability for any claims arising from our services shall not exceed the amount of fees paid by the client for the specific service giving rise to the claim.
Insurance and Caregiver Coverage
Assisted Living Florida maintains:
- General liability insurance
- Workers' compensation insurance for employees
- Professional liability coverage
- Fidelity bond coverage
Confidentiality
We respect the privacy and confidentiality of our clients. All caregiver and care information is kept confidential in accordance with our Privacy Policy and HIPAA compliance requirements.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes arising under these Terms shall be resolved in the courts of Florida.
Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of our services after any changes indicates your acceptance of the modified Terms.
